CONDITIONS RELATING TO THE SWATCH ART PEACE HOTEL TRACE
Artists who participate in the Swatch Art Peace Hotel Guest Artist Program will be asked to leave behind a “trace” of their work on completion of their stay. Ideally, this trace should be representative of the artist’s experience at the Swatch Art Peace Hotel. However, it is up to each artist to determine just what constitutes “a trace”, and what form it should take. Swatch Group is committed to supporting the arts and will treat all traces with due consideration and respect.
The traces left at the Swatch Art Peace Hotel must be free of any present or future rights or claims made either by the artists or by third parties and should be given wholly to Swatch Group to be handled and used at its discretion, without any payment or obligation either to the artist or to any third party. Artists who are under contract to third parties will be asked to show proof of the said third party’s consent to this condition.
Artists grant to Swatch Group and all Swatch Group subsidiaries the irrevocable worldwide right to use the trace as follows:
1. Artists grant to Swatch Group the worldwide copyright on the trace (or part of the trace) and the right to play, publish, make available to the public, perform, display, reproduce, distribute and otherwise use the trace or part of the trace worldwide for an unlimited period of time in any and all present and future media.
2. Artists grant to Swatch Group the right to host, store, translate, lend or sell the trace or part of the trace worldwide at its entire discretion and for an unlimited period of time.
3. Artists grant to Swatch Group the right to use the trace or part of the trace in connection with promotional, advertising and public relations activities of its subsidiaries worldwide, for an unlimited period of time, in any and all present and future media.
4. In the event that Swatch Group selects, with the agreement of the artist, a specific trace for the creation of a Swatch watch, Swatch Group and Swatch Ltd. are granted permission to adapt the trace or part of the trace, if necessary, to special watch design requirements.
Artists will be given an opportunity to have their trace presented in the Swatch Art Peace Hotel’s virtual museum, along with additional material considered representative of their work. However, Swatch Group has no obligation to publish submitted material and reserves the right not to publish material which does not comply with the Swatch Art Peace Hotel concept or which is considered inappropriate.
